The truth: Article 2 of the "Regulations on Paid Annual Leave for Employees" stipulates that employees of government agencies, organizations, enterprises, public institutions, private non-enterprise units, and self-employed individuals with employees who have worked continuously for more than one year are entitled to paid annual leave. The "Implementation Measures for Paid Annual Leave for Enterprise Employees" stipulates that employees who have worked continuously for more than 12 months are entitled to paid annual leave. The General Office of the Ministry of Human Resources and Social Security clarified in its "Reply on Relevant Issues Concerning the 'Implementation Measures for Paid Annual Leave for Enterprise Employees'" (Ren She Ting Han [2009] No. 149) that "employees who have worked continuously for more than 12 months" includes both situations where an employee has worked continuously for more than 12 months in the same employer and situations where an employee has worked continuously for more than 12 months in different employers.
